In the “FINAL Comparison for Board Straw Vote” that was posted to Board of Education of Howard County website, BoardDocs for the Nov 21st two different FARMs data sets were used to calculate the “no change” and “board plan” FARMs rates data. Based on the note on the spreadsheet, the data was changed due to direction from the General Counsel about how the numbers were calculated. Please provide the original FARMs number and percentage for each polygon and the new FARMs number and percentage for each polygon based on the new process directed by the General Counsel, as allowable. Please provide this data in Excel format.

Responsive to this request, original data can be found on the Boundary Review Process website under Feasibility Study Data Downloads, with FARMS counts and percentages by polygon found under the file FARMS Representation: https://www.hcpss.org/school-planning/boundary-review/process/#feasibility-study. FARMS data used during Board work sessions, which relied on the same base data but calculated specifically at the school level, was contained within the referenced document FINAL Comparison for Board Straw Vote under the Capacity and Unitization tab. No new polygon-level data similar to that previously produced for the Feasibility Study was created. Under the MPIA process, and as advised in the Fourteenth Edition of the Maryland Public Information Act Manual created by Maryland’s Office of the Attorney General, an agency is only obligated to produce existing records and is not required to “create records to satisfy a PIA request.” Per the MPIA GP § 4-205(c)(4)(iii), an agency is also not required to program a new record if the type of data extraction requested is outside its normal course of business.
