Responsive to this request, information regarding number of special education services hours, the types of services and any incomplete/compensatory services owed is examined per student when making specific IEP decisions about that student and not collectively maintained data. Please note, under the MPIA process, and as advised in the Seventeenth Edition of the Maryland Public Information Act Manual created by Maryland’s Office of the Attorney General, an agency is only obligated to produce existing records and is not required to generate new data or summarize data. This information is maintained within individual student records, which would require access to and review of individual private student files, which are exempt from disclosure under both the Family Educational Rights and Privacy Act of 1974 (FERPA), which restricts access to student records, and MPIA GP § 4-313, which prevents disclosure of school district records pertaining to individual students.
The Baltimore Banner
The Baltimore Banner is requesting the number of Howard County Public School students who had incomplete special education service hours and related services, the type of services students went without, the number of service hours the students were supposed to get and the number of hours that were actually provided during the 2021-2022 school year.
