Responsive to this request, and per clarification you are seeking data for compliance “with IEPs that have been finalized but not disseminated and/or staff being trained on the new IEP,” Department of Special Education staff is not aware of existing data on the time between finalizing an IEP and sharing with staff. Under the MPIA process, and as advised in the Seventeenth Edition of the Maryland Public Information Act Manual created by Maryland’s Office of the Attorney General, an agency is only obligated to produce existing records and has no obligation to create records or generate new data to satisfy an MPIA request.
