Responsive to this request, proposal records can be found under this prior MPIA response: https://mpia.hcpss.org/requests/2023-137. In regard to the evaluation committee’s score/evaluation records, under MPIA GP § 4-344, which allows a custodian to deny inspection of confidential opinions, deliberations, advice or recommendations from one governmental employee or official to another for the purpose of assisting the latter in the decision-making function, we would be unable to release. These records reveal pre-decisional recommendations of the evaluation committee used to inform the award by the Purchasing Office, where release would be contrary to the public interest given its potential to inhibit full and frank discussion in the procurement process.
Per indication you are also seeking any in-person presentations from the vendors not included in the prior MPIA, the attached record for First Student Inc. is in addition to one from Zum Transportation Services, Inc. found under the prior MPIA response above. Under MPIA GP § 4-335, which prevents disclosure of confidential trade secret, commercial or financial records furnished by an outside unit, customer reference information (also under MPIA GP § 4-310), information regarding technological innovations developed by First Student and proprietary program approaches including internal recruitment and retention principles, and safety, training, and maintenance techniques have been redacted throughout the document as they have the potential to cause harm to the competitive position of the vendor from whom the information was obtained and/or impair our ability to obtain similar information in the future.
