HCPSS MPIA Request #2018-190

Requested Information
Regarding an AAC meeting & Maryland Open Meetings Act

I am seeking emails, texts, and/or other documents to explain the discrepancy between the Open Meetings Act requirement and the private meeting held by this committee. An earlier article said Dr. Martirano would have the AAC send him information electronically. Then, the article below states the group "privately reconvened." I am seeking information about meetings only, not celebrations or gatherings by group members after they had completed and submitted their work.

Mostly, I'm trying to figure out if the AAC met together as a group for the meeting in question, and if you are able to respond to that question directly, that will be fine too, and then I will submit a separate request if I end up needing documents.

Policy 6010 V-C states: "All AAC meetings are subject to the Maryland Open Meetings Act. ..." http://www.hcpss.org/f/board/policies/6010.pdf

In contrast, a news article cited below states, "Following Martirano’s proposal, the Attendance Area Committee privately reconvened to incorporate the acceleration of the northeastern high school’s construction into their findings."

Response Notes

Per clarification - for the meeting Dr. Martirano held to review the AAC’s revised proposal based on HS #13, with them present, documents requested include “minutes from the meeting and a copy of the meeting announcement, as well as anything that indicates when and where the meeting was announced.” Responsive to this request, there are no existing meeting announcements nor were minutes taken during the referenced meeting. For reference, documents presented by the AAC members at this meeting are posted under September 27, Alternative AAC Scenario on the AAC website, including their executive summary: http://www.hcpss.org/f/schoolplanning/aac/aac-alt-scenario-executive-summary.pdf and a scenario rationale: http://www.hcpss.org/f/schoolplanning/aac/aac-alt-scenario-rationale.pdf.

*Some request language is summarized to include the requester's specific document requests and legally protected information (such as personally identifiable information of a student) or personal, defamatory and malicious content removed at the discretion of the school system.

**Responses containing legally protected information available only to the person of interest are omitted from the above report.
