Responsive to this request, no existing records outline the technical steps used in both the old and new data reporting processes, however the shift was explained by staff verbally at the November 21, 2019 Board of Education meeting: http://go.boarddocs.com/mabe/hcpssmd/Board.nsf/goto?open&id=BHVK9W5058E1 (starting at 3:39:00 within the video tab). Additionally, under MPIA GP § 4-301(1), which requires a custodian to deny inspection of a record if by law, the public record is privileged or confidential, we are denying access to two email records containing direction from the General Counsel on this matter as attorney-client communications.

In the “FINAL Comparison for Board Straw Vote” that was posted to Board of Education of Howard County website, BoardDocs for the Nov 21st two different FARMs data sets were used to calculate the “no change” and “board plan” FARMs rates data. Based on the note on the spreadsheet, the data was changed due to direction from the General Counsel about how the FARMs numbers were calculated. Please provide exactly what process and parameters were used previously to calculate the FARMs numbers and the new process and parameters that are now used at the direction of the General Counsel. Please provide all additional information related to this change.
