As advised in the Fourteenth Edition of the Maryland Public Information Act Manual created by Maryland’s Office of the Attorney General, “an agency has no obligation to create records to satisfy a PIA request.” Therefore, under the MPIA process itself, HCPSS is not required to further clarify information, such as the dates, times and names of who was contacted for the position of Acting Superintendent. The existing record the Board indicates addressed these questions was the previously provided email dated July 5, 2017.
