Shortly after Ms. DeLacy became a BOE member she publicly stated HCP$$ had gathered a file on her that was about 6 inches thick. She stated the file was shown to her by Ms. Foose and was told the file was to be used against her. According to Foose's "retirement agreement" ALL property of the HCP$$ was to be returned which includes this file. I am requesting a copy of this file, the names of all personnel who contributed to or participated in the creation of this file, the names of all personnel who handled this file, and all costs the public incurred in creating, storing or handling this file. As always I request you provide this information electronically and waive any and all fees as I will release it publicly via Howardpubliced.
Following a search of existing Board, Superintendent and Legal Services files where such a file might reasonably exist, we have been unable to locate any records responsive to this request.
As advised in the Fourteenth Edition of the Maryland Public Information Act Manual created by Maryland’s Office of the Attorney General, an agency is only obligated to produce existing records and is not required to answer questions that would “create records to satisfy a PIA request.” Furthermore, because we have been unable to locate the file itself, a search of all HCPSS records or correspondence for specific answers to the above – presuming it could have been over a number of years and between a number of current and/or former employees – would be an unreasonably broad request.
In response to your specific request for costs related to handling such a file, a search of existing HCPSS MPIA files going back several years did not result in any requests for a similar file.
