Requested Information

Response Notes

Responsive to this request, involuntary student transfers made by the Division of School Management and Instructional Leadership are not tracked in an existing report/record. Such decisions are made on a case by case basis and resulting actions are kept in individual student records, which would require access to and review of private student files. Under the Family Educational Rights and Privacy Act of 1974 (FERPA), which restricts access to student records, and MPIA GP § 4-313, which prevents disclosure of school district records pertaining to individual students to anyone other than the parent/student in interest, we are denying your request to determine underlying policy violations in such cases.

*Some request language is summarized to include the requester’s specific document requests and remove legally protected information (such as personally identifiable information of a student).
