Requested Information
On September 8, 2011 a bids and contracts recommendation was approved by the Board of Ed for contracted legal services (attached) with 3 law firms.  It included applying firm names, hourly rates for partners, associates, and paralegals, as well as the names of the HCPSS review panel recommending the selection of firms (including a Board of Ed member).  The terms of the contract included "an initial one-year period with the option to extend the contract for an additional four one-year periods subject to satisfactory performance and funding."  On December 3, 2012, another bids and contract was approved for legal services with the same options for extensions. 
However, I am unable to find any subsequent bids and contracts for legal services that have come before the Board for approval since those in 2011 and 2012.  The latest monthly legal fees reports shows total legal costs paid in FY2020 as $173,728.89. 
Thus, I am requesting the documentation of Board approval of the existing legal services contract, the RFP for the current contract, and the listing of evaluation members of the current contract.

Responsive to this request,all current agreements for legal services can be found under our response to MPIA 2018-387: https://mpia.hcpss.org/requests/2018-387(each listed here have been renewed for the current year) along with the original RFP 009.17.B1 from 2016. No existing records document Board approval. Please note, HCPSS Policy 4050 Procurement of Goods and/or Services IV(S) indicates legal services are exempt from this policy. Additionally, the Purchasing office was not able to locate a listing of staff who evaluated RFP responses, but indicates it would have consisted of staff from respective areas/services sought (such as workers compensation, special education, operations, the Board office, etc.).
