2017-18 CRDC
In October 2017, OCR received OMB approval to require all local educational agencies (LEA) in the country, including every public school district, charter schools, juvenile justice facilities, alternative schools, and schools serving only students with disabilities, to respond to the CRDC for the 2017-18 school year.
As a result, I am requesting each of the 2017-2018 HCPSS school-specific data that was required to be submitted to OCR for restraint and seclusion events as described in the attached document on pages 103 through 107 (and as delineated by age, race, gender, ELL, and disability). I understand that numbers below 10 per school may be redacted per Maryland's determination under FERPA.
Responsive to this request, and per clarification you are seeking the most recent data, staff indicates restraint and seclusion data submitted to OCR is done bi-annually with 2017-2018 being the most recent report as 2019-2020 was skipped due to the pandemic. The content and breakdown of this report is created specifically per data reporting instructions from OCR, therefore there is no equivalent current report and the next collection starts this coming October. Under the MPIA process, and as advised in the Fourteenth Edition of the Maryland Public Information Act Manual created by Maryland’s Office of the Attorney General, an agency is only obligated to produce existing records and is not required to summarize existing data or program/generate new reports that are not already used in the normal course of business.
