Responsive to this request, as you have noted you are seeking the above in relation to “Mr. Motley’s role in the creation of a statement issued by the National Association for Secondary School Principals (NASSP) on September 16, 2021,” such records would not fall within the purview of a public record of the HCPSS. In particular, MPIA GP § 4-101 (k) (1) (i) defines a public record as the original or any copy of any documentary material that is made by a unit or an instrumentality of the State or of a political subdivision or received by the unit or instrumentality in connection with the transaction of public business. Mr. Motley indicates his involvement with this organization is for personal professional development, and as such, would not constitute the transaction of HCPSS business for which records are subject to release by HCPSS under the MPIA.
