Responsive to this request, and per clarification on the scope of the communications sought, please find attached those emails located via a search of the @hcpss system between 8/20/19 and 12/1/19 with the participant “dan newberger” or “daniel newberger.” Under the Family Educational Rights and Privacy Act of 1974 (FERPA), which restricts access to student records, and MPIA GP § 4-313, which prevents disclosure of school district records pertaining to individual students, we have redacted any reference to a particular student, or personally identifiable information that would reveal student information from the responsive records. Additionally, under MPIA GP § 4-330, we have redacted sociological information where it contains personal addresses and/or has the potential to pose a risk to individual privacy. Please note, further review would be needed to determine releasability of all attachments, links and/or external records noted within the responsive email (document) content itself.

As advised in the Seventeenth Edition of the Maryland Public Information Act Manual created by Maryland’s Office of the Attorney General, “Even if some identifying information is stripped from the student records, the exemption would still apply if a person could readily match students with the disclosed files.” As such, we have also withheld 29 email chains in their entirety as related to individual student and family matters given the release of any portion has the potential to identify the student to which they pertain.
