Requested Information
I am requesting the following information:
1. Records listing names of staff who received the HCPSS restraint training (Safety-Care or other) or Ukeru training by school for the 2022-2023 and 2023-2024 school years 2. Records indicating the training or certification of those providers, teachers, or trainers who provide HCPSS restraint training or Ukeru training for staff. 3. Any available data (e.g., counts, school locations, grade levels) on injuries to students or staff that occurred during, or as a result of, restraint or seclusion procedures during school years 2022-2023 and 2023-2024. 4. Copies of any memoranda sent to the HCPSS Board of Education between April 1st, 2023 and December 31st 2023 with either the words “Restraint” or “Seclusion” in the Subject. 5. Any correspondence between HCPSS and MSDE regarding corrective action plans created as a result of excess use of restraint, violations of Maryland restraint and seclusion regulations, or restraint or seclusion-related deficiencies noted during MSDE reviews of HCPSS special education.

Responsive to this request, regarding number five, if referring to the requirements of Education Article § 7-1101, MSDE has not implemented a formal corrective action process at this time, but in the meantime is scheduling meetings with schools as needed per the statute. Staff indicated HCPSS has not received any communication regarding corrective action or needing to meet with MSDE to date. While data regarding injuries to students and staff is being manually collected in individual incident reports, there is not currently a report of total injuries or summary information. Under the MPIA process, and as advised in the Eighteenth Edition of the Maryland Public Information Act Manual created by Maryland’s Office of the Attorney General, an agency is only obligated to produce existing records and is not required to generate new data or summarize data. Please note, staff anticipates a report of such data to be available at the end of SY23-24 and for future use in monitoring injuries caused by restraint incidents.
