Based upon new information and a re-examination of the applicability of the MPIA to the joint public-private use of the account in this instance, we have re-issued our response to MPIA 2018-429.

MPIA request 2108-429 denied the request to review the accounts blocked by the "personal account" of the Superintendent. That account is clearly related to the business of HCPSS - responding to tweets related to school system personnel related to school system business. It is disingenuous to state that it is not subject to the MPIA, per Attorney General Opinion 81-140 (see attached) that determines electronic records on personal computers of public officials are subject to the MPIA when used for public business. I therefore request that the original MPIA request be honored.
